Family seeks answers after police kill Texas woman at home

FORT WORTH, Texas 鈥 A white police officer who killed a black woman inside her Texas home while responding to a neighbor鈥檚 call about an open front door 鈥渄idn鈥檛 have time to perceive a threat鈥 before he opened fire, an attorney for the woman鈥檚 family said.

鈥淵ou didn鈥檛 hear the officer shout, 鈥楪un, gun, gun,'鈥 attorney Lee Merritt said after viewing video taken from a Fort Worth officer鈥檚 bodycam during Saturday鈥檚 shooting of Atatiana Jefferson, 28. 鈥淗e didn鈥檛 have time to perceive a threat. That鈥檚 murder.鈥

Her family told KXAS television that Jefferson was watching her 8-year-old nephew when she was killed early Saturday.

The Fort Worth Police Department said in a statement that officers saw someone near a window inside the home and that one of them drew his duty weapon and fired after 鈥減erceiving a threat.鈥 The video released by police shows two officers searching the home from the outside with flashlights before one shouts, 鈥淧ut your hands up, show me your hands.鈥 One shot is then fired through a window.

鈥淚t鈥檚 another one of those situations where the people that are supposed to protect us are actually not here to protect us,鈥 said Jefferson鈥檚 sister, Amber Carr.

鈥淵ou know, you want to see justice, but justice don鈥檛 bring my sister back,鈥 Carr said.

An aunt, Venitta Body, said the family does not understand why Jefferson was killed.

鈥淚t鈥檚 like from the moment we got the call, it鈥檚 been more and more inconceivable and more confusing. And there has nothing been done in order to take away that confusion,鈥 Body said.

Police Lt. Brandon O鈥橬eil said Sunday that the officer, who鈥檚 been on the force since April 2018, is on administrative leave pending the outcome of an investigation and will be interviewed about the fatal shooting on Monday. His name was not released.

At a brief news conference at police headquarters, O鈥橬eil confirmed that the officer did not announce he was police before he fired the fatal shot and that his failure to do so is part of the department鈥檚 investigation.

O鈥橬eil also confirmed that Jefferson鈥檚 8-year-old nephew was in the room with Jefferson when she was shot. He said representatives of the police department have spoken with the woman鈥檚 family and 鈥渟hared our serious and heartfelt concern for this unspeakable loss.鈥 Her family has said she was watching her nephew at the time.

O鈥橬eil declined to answer reporters鈥 questions and said Fort Worth Police Chief Ed Kraus plans to conduct a more in-depth news conference on Monday.

James Smith, who called a police non-emergency number about the open door, told reporters he was just trying to be a good neighbor.

鈥淚鈥檓 shaken. I鈥檓 mad. I鈥檓 upset. And I feel it鈥檚 partly my fault,鈥 Smith said. 鈥淚f I had never dialed the police department, she鈥檇 still be alive.鈥

Smith said Jefferson and her nephew typically lived with an older woman, who鈥檚 been in the hospital.

鈥淚t makes you not want to call the police department,鈥 he said.

In an audio recording of Smith鈥檚 call that was released by police, the neighbor said it was 鈥渘ot normal鈥 for the house to leave its front door open for hours at that time of day.

Merritt said Jefferson鈥檚 family expects 鈥渁 thorough and expedient investigation.鈥

The Fort Worth Police Department said it released bodycam footage soon after the shooting to provide transparency, but that any 鈥渃amera footage inside the residence鈥 could not be distributed due to state law. However, the bodycam video released to media included blurred still frames showing a gun inside a bedroom at the home. It鈥檚 unclear if the firearm was found near the woman, and police have not said that the officer who shot her thought she had a gun. The police statement released Saturday said only that officers who entered the residence after the shooting found a firearm. Police did not immediately respond to a message seeking comment Sunday.

Democratic presidential candidate Sen. Bernie Sanders on Sunday called on the Justice Department to investigate.

鈥淭he killings of unarmed Black Americans have got to end,鈥 Sanders tweeted. 鈥淎tatiana Jefferson should be alive.鈥

The shooting comes less than two weeks after a white former Dallas police officer was sentenced to 10 years in prison after being convicted of murder in the fatal shooting of her black neighbor inside his own apartment. Amber Guyger, 31, said during her trial that mistook Botham Jean鈥檚 apartment for her own, which was one floor below Jean鈥檚. Merritt also represents Jean鈥檚 family.
