Albay Gov. Rosal to appeal Comelec disqualification ruling

LIGAO CITY — Albay Gov. Noel Rosal on Monday (September 19) said he would appeal the disqualification ruling issued against him by the Commission on Elections (Comelec) First Division.

In a statement, Rosal said the Comelec’s resolution on Monday was not final and executory.

“We have five days from receipt or up to 24 September to file an MR (motion for reconsideration) with the Commission en banc,” he said.

He said Comelec’s decision might also be brought to the Supreme Court.

“I will continue to function as your governor until the court orders with finality and executory to vacate the position,” Rosal stressed.

He also asked the people of Albay to “stay calm” as he thanked them for supporting him.

The Comelec ruling stemmed from a petition filed in April by defeated Legazpi City council candidate Joseph Armogila, who sought Rosal’s disqualification for reportedly approving his capacity as then mayor of Legazpi, cash aid for tricycle drivers and senior citizens between March and April.

According to Comelec’s First Division, Rosal committed an election offense by violating the ban on public spending. INQ
