No arrest order for Napoles children

MANILA, Philippines – No warrants of arrest were issued against the children of Janet Lim-Napoles who have been charged with graft and corruption.

Aside from Jo Christine and James Christopher Lim Napoles, no warrants of arrest were issued against Enrile’s co-accused for graft: Fernando Ramirez, Aileen Palama, Amparo Fernando, Jesus Castillo, Dorilyn Agbay-Fabian and Renato Ornopia.

Third Division member Associate Justice Samuel Martires recommended that the Office of the Special Prosecutor be required to produce additional evidence against these individuals, citing Section 6 of the Rules of Criminal Procedure which states that “in case of doubt on the existence of probable cause, the judge may order the prosecutor to present additional evidence…”

He also recommended that a reinvestigation be conducted on allegations of graft against Hernani Ditchon, Rodrigo Galay and Laarni Uy.

On the other hand, the case against Margarita Guadinez has been recommended for dismissal after the prosecution failed to show her participation to the crime.
